These Terms & Conditions govern purchases made through this website. Please read them carefully before placing an order.
1. About the Seller
This website and online store are operated by Manuela De Simone, an independent figurative artist based in Berlin, Germany.

2. Artworks and Products
Manuela De Simone offers original paintings, limited edition Fine Art prints, hand-embellished editions, and other selected artistic works.
Each original painting is a unique work of art. Limited edition prints are produced in specified quantities, as indicated on their respective product pages.
Every effort is made to represent artworks accurately through photographs and descriptions. However, slight variations in colour may occur due to screen settings, lighting, and the characteristics of original materials.
Individually hand-finished editions may feature subtle differences that reflect the artist's manual work.
These natural variations do not affect your statutory rights if an artwork does not conform to its description.
3. Prices and Payment
Product prices are displayed on the website in the currency selected for your region.
The total price, including applicable taxes and shipping charges, is shown during checkout before the order is submitted.
Payments are processed securely through the payment providers available at checkout.
For deliveries outside the European Union, additional import duties, taxes, or customs handling fees may apply. Unless explicitly stated otherwise at checkout, these charges are the responsibility of the recipient.
4. Placing an Order
To place an order, select the desired artwork, add it to your cart, and proceed through checkout.
You can review your order details and correct any errors before submitting your purchase.
By completing checkout, you submit a binding offer to purchase the selected items.
An order confirmation will be sent to the email address provided during checkout. The purchase contract is concluded when we accept your order.
If an artwork becomes unavailable or an order cannot be fulfilled, you will be informed promptly and any payment received for the unavailable item will be refunded.
Order details are provided by email, and these Terms & Conditions can be viewed and saved from the website.
5. Shipping and Delivery
All artworks are carefully prepared and packaged in the artist's Berlin studio.
Orders are normally dispatched within 7 business days, unless otherwise indicated on the product page.
Shipping methods, costs, and estimated delivery times depend on the destination and the artwork purchased.
Original paintings and Fine Art prints may require different packaging or separate shipments.

For consumer purchases, the risk of accidental loss or damage during delivery passes in accordance with applicable consumer law.
6. Copyright and Intellectual Property
All original artworks, illustrations, images, designs, and written content created by Manuela De Simone remain protected by applicable copyright law.
Purchasing an original artwork or Fine Art print transfers ownership of the physical item, but does not transfer copyright or commercial reproduction rights.
Reproduction, commercial distribution, licensing, or commercial use of the artwork requires the artist's prior permission, unless otherwise permitted by applicable law.
This does not restrict the lawful owner's statutory rights, including permitted exhibition, resale, or other uses allowed by law.

7. Returns and Right of Withdrawal
Consumers have the statutory right to withdraw from eligible online purchases within 14 days without giving any reason, in accordance with applicable consumer protection laws.
No additional voluntary return period is offered.
Signed, numbered, limited edition, or hand-embellished artworks are not automatically excluded from statutory withdrawal rights.
Artworks specifically commissioned or clearly personalized according to an individual customer's requirements may be subject to legal exceptions.

Nothing in these Terms limits your mandatory consumer rights.
8. Damaged or Defective Artworks
Each artwork is packaged with care.

Please provide your order number and, where possible, photographs of the item and packaging.
Your statutory rights concerning defective goods remain fully applicable.
9. Liability
Manuela De Simone is responsible for her contractual obligations in accordance with applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for intentional misconduct, gross negligence, or injury to life, body, or health.
Statutory consumer rights, including rights relating to defective goods, remain unaffected.
